A man wanted on an ICE detainer was arrested on a Cape Cod beach after a woman told police he performed a lewd act in front of her on Monday, Barnstable Police reported.

Cesar Perez-Velazquez also allegedly gave officers a fake name during booking: “Pedro Martinez.”

The 28-year-old man was charged with gross and open lewdness, misleading a police officer and being a fugitive on a previous court warrant from New Hampshire. He was also wanted on an ICE detainer.

After 7:30 p.m. Monday, police received a tip from a woman on Kalmus Beach in Hyannis that a man had allegedly exposed his genitalia to her and performed a lewd act, according to the arrest report. When police arrived, the woman reportedly showed officers photos of the incident on her phone and pointed to where she saw him.

Police located Perez-Velazquez, who matched the description and images of the suspect, still on the beach, the report states. The suspect reportedly denied the allegation and refused to cooperate, leading police to lift him by the armpits and drag him across the sand until they reached the parking lot.

The middle button of his pants was still undone when he was placed in the cruiser, officers said in the arrest report.

Perez-Velazquez gave officers a fake name during booking, “Pedro Martinez,” the arrest report said. Officers discovered his real identity after running his fingerprints.

Police later found that the suspect was wanted in New Hampshire for jumping bail on an OUI offense in Salem. ICE also reported Perez-Velazquez was wanted for deportation from the country.

Perez-Velazquez was ordered held on bail.
