Minutes ago, the text of the bipartisan national security funding bill was released. It:

-funds Ukraine, Israel, and humanitarian relief
-secures our border and reforms our asylum law

1/ As the co-author of the immigration provisions, here's a THREAD on the key elements:


2/ First - it would be easy to just keep immigration and border policy as a political cudgel for another 40 years. But politics at its best is about finding bipartisan compromise on the toughest issues. That's what we've done here.

Here's a snapshot of what's in the bill.

It's "bipartisan" because Corporate Fake Republicans like McConnell and Lankford and Thune and Corwyn are and always have been open borders fanatics who must be driven from office if the Republic is to be saved.

3/ A quicker, fairer asylum process. No more 10 yr wait. Claims processed in a non-detained, non-adversarial way in 6 months.

Non-adversarial proceedings = no one checking the illegals' fake claims of political persecution which makes them eligible for asylum.

As Brett Weinstein said (see the sidebar), these illegal aliens make no claims of political persecution when en route to the US. They all admit they're crossing the border for economic reasons. It's only when they get to the border and are given a guide to defrauding the US government and its citizens by leftwing Soros-funded NGOs that they discover they're supposed to lie and claim they're seeking political asylum.

A slightly higher asylum screening standard at the border.

Also, no more waiting for work permits. Most asylum seekers can work immediately.

So there's even more incentive to illegally cross the border and make false political asylum claims?


4/ A brand new right to legal representation for all immigrants. Remember when Trump denied lawyers to victims of the Muslim ban? Never again.

Perfect! No one can be denied entry again -- and if we do deny a terrorist entry, we have to pay for their lawyer to fight the denial.

And...the first ever government paid-for lawyers for young unaccompanied minors. A long standing injustice righted.

Boy this "deal" sure seems awfully stacked on the "benefits for illegals" side of the "deal."

Here's "the border never closes" line: He makes it clear that even when illegals exceed 5,000 per day (or 150,000 per 30-day month, 20,000 higher than the absolute peak monthly illegal immigration under Trump), the border is not closed. Illegals are just processed at official ports of entry rather than ad hoc at the border.


5/ A requirement the President to funnel asylum claims to the land ports of entry when more than 5,000 people cross a day. The border never closes, but claims must be processed at the ports.

It's not even closing the border, as Biden has repeatedly claimed it was -- it's just "funneling" the illegals to official points of entry, where the law already requires aliens to enter through.

Now Murphy admits that this power merely to "funnel" illegals to ports of entry is only usable a "limited number of days per year."


This allows for a more a more orderly, humane asylum processing system.

6/ But...important checks on that power. It can only be used for a limited number of days per year. It sunsets in 3 years. Emergency cases that show up in between the ports still need to be accepted. The ports must process a minimum of 1400 claims a day.

Ah-ha! Even when Biden "closes the border," which Murphy admits never happens, but instead just results in claims being processed at ports of entry, exceptions are still made for "emergency cases!"

And all of these people are already lying about being political asylum seekers! But they'll never be coached into also claiming "emergency" status, huh?

The Border Emergency Authority has been the most misunderstood or maybe just misrepresented parts of the bill. Some people have said it would mean 5,000 people a day are coming into the country every day. That is absurd and untrue


The emergency authority is not designed to let 5,000 people in, it is designed to close the border and turn 5,000 people around.

Really?

Where is the language about turning this 5000/day away from the border? It's not there. You mean that if there are more than 5000 per day, that excess can be turned away -- but your Democrat co-conspirator Chris Murphy admits that doesn't result in anyone being turned away, but merely "funneled to ports of entry."

And setting a 5,000/per day level as "acceptable" is encoding into law the idea that around 2 million illegals per year (5000 x 365) are permitted to enter the country illegally without suffering any consequence.

The Border Emergency Authority only lasts 3 yrs to force this Admin to shut down the border & to give time for the next POTUS to hire more agents & more officers. After three years, the emergency authority expires because we should have regained full control of our border by then

I don't want to start any rumors, but James Lankford looks like the kind of guy who funnels illegal trespassers into his own ports of entry, if you catch my meaning.

I've been covering the border since 2019 and this border bill is exactly what's wrong with how D.C. tries to "fix" a problem: Spends more money, gives more power to the feds, and doesn't actually solve the problem.

Again, a bill from Congress is not needed to solve the acute problem at the border. Biden just needs to undo the executive orders he signed on day one. The historic influx of illegal immigrants was started by the policies his administration has recklessly pursued.

I've seen enough. This bill is even worse than we expected, and won't come close to ending the border catastrophe the President has created. As the lead Democrat negotiator proclaimed: Under this legislation, "the border never closes."

If this bill reaches the House, it will be dead on arrival.

Unfortunately there's a lot of emotion about this border deal and no analysis of the facts by people who should know better. Many people (who are apparently very fast readers!) have already tweeted completely false statements about the legislation.

Tune in for an objective look at this border deal as I read through it. Just facts. Not emotion.

It's important to address some of the more bizarre concerns right away.

"Why do we need new laws? Isn't current law enough?"

Obviously we do need new laws. That's why Republicans passed HR2, which was mostly new immigration law. Those advocating for HR2 can't also claim we don't need new laws. This bill isn't HR2, but my simple standard will be "does it decrease illegal immigration or not?"

And if we didn't need new laws, why was immigration so out of control even when Trump was President? Our laws have too many loopholes. Trump had to make an international agreement with Mexico to get the border under control.

It surprises me that I have to say this, but I will: WE SHOULD NOT HAVE TO RELY ON MEXICO TO SECURE OUR BORDER.

We should be able to rely on laws that are clear enough so that no President can bypass them.

This is so stupid -- people are saying "we don't need new laws" to rebut Biden's claim he needs legal authority to enforce the border. He already has that authority -- he is currently choosing not to use that authority.

He wants goodies for illegals in exchange for... well, for nothing. While this bill gives him the authority to close the border -- I mean, funnel illegals to ports of entry -- when and only when illegal crossings exceed 5000 per day, nothing in the law requires him to exercise this authority.

We are granting Biden and Schumer everything they want, and in exchange, we give Biden discretionary authority to close the border -- I mean, funnel illegals to ports of entry -- if he feels like using it.

Thusfar in his presidency, he has not chosen to enforce the border at all. He's actually taken Texas to court for daring to seal off parts of their own border!

Why would Eyepatch John McCain think he can lie to us and make us believe Biden's going to become Joe Border Hawk with this discretionary authority?

Which is barely any new authority at all! If more than 5000 illegals cross in one day, Biden can -- if he feels like it -- "funnel excess illegals to official ports of entry."

How does this help protect the border?

It doesn't. It makes it officially open.

And fuck this neocon cunt for pretending otherwise.

Is there no one in his district who will man up and run against him?
