NextImg:Surprise! Very Special Counsel David Weiss, the Man Merrick Garland Assigned to "Prosecute" Hunter Biden, Worked With Beau Biden For Years

I guess he forgot to disclose this possible conflict of interest.

Whoops!

Whoopsie!

David Weiss, the special counsel appointed to investigate Hunter Biden, spent years working with his late older brother Beau Biden, who was then-Delaware attorney general, a report Sunday set out.

The Washington Post reported that between 2007 and 2010 when Weiss was acting U.S. attorney for Delaware, he worked "hand-in-glove" with the elder Biden brother, and he likely ran into Joe Biden at the time, as well.

As detailed by the Post, in 2007, U.S. Attorney for Delaware Colm Connolly hired Weiss as first assistant U.S. attorney. When Connolly stepped down following Obama and Biden's election, Weiss became the acting U.S. attorney for the next two years, until the Obama administration appointed someone to the position.

According to the outlet:

As the top federal prosecutor in Wilmington, Weiss collaborated with his local equivalent: Beau Biden, who had been elected Delaware attorney general in 2006. Weiss and Beau Biden conducted joint investigations and determined which office had jurisdiction in various cases.

Tim Mullaney Sr., who served as Beau Biden's chief of staff at the state attorney general's office, said the office often worked with the U.S. attorney's office during Weiss's tenure. He didn't believe Beau Biden and Weiss had a relationship outside of their work. "We are always working hand-in-glove with federal government; there's nothing unusual about that."

The Post also noted "it also wouldn't have been strange for Weiss to run into Joe Biden."

Thick as thieves. Weiss intended to let Hunter Biden off without even any kind of charge at all, and was only "pressured" into forcing Hunter to plead to two misdemeanors (with no actual penalty) due to the IRS whistleblowers telling Congress about Weiss making every single decision for the benefit of Hunter Biden.

And that's not all. Politico reported on documents leaked by the Hunter Biden legal team which prove that the prosecutors did in fact promise Hunter Biden Double Secret Immunity from all possible crimes that he might have committed in the past, and tried to sneak that in to the plea deal without alerting the judge to this fact.

Which means that it's now proven that the prosecutors lied to the judge when they claimed, in response to her direct question, if they were granting Hunter Biden immunity for any crimes not before the court (that is, the two tax evasion cases on the lying-on-a-gun-form felony).

As you can see US Attorney David Weiss was doing exactly what we all pretty much knew he was doing: finding a way to cover for Hunter Biden while covering his own butt. He was originally going to simply produce an agreement--one which would never have gone before a judge--to not prosecute Hunter if he remained a good boy for several years. The first draft of the deal as reported by Politico would have been essentially a get-out-of-jail-free card.

On May 18, another lawyer for Biden sent two Delaware prosecutors -- including Lesley Wolf, a senior prosecutor in the Delaware U.S. Attorney's Office -- the first draft of a proposed deal, structured so it wouldn't need a judge's sign-off and wouldn't require a guilty plea from Biden.

As part of the deal, Biden would admit he was late filing his taxes for 2017 and 2018, and that he owned a gun while he was using drugs. He would promise to pay any taxes he still owed, to pay his taxes on time for the next five years, and to never own a gun again. The deal would be made public, and it would also cover three corporate entities affiliated with him.

If he upheld his end of the bargain through January 2025, the Justice Department would promise not to prosecute him for anything they'd investigated thus far. The draft wording of that promise was clear and broad: "The Department of Justice agrees not to criminally prosecute Robert Hunter Biden and the affiliated businesses (namely: Owasco P.C.; Owasco LLC; and Skaneateles LLC): (a) for any federal crimes arising from the conduct generally described in the attached Statement of Facts (Attachment A); or (b) for any other federal crimes relating to matters investigated by the United States."

Weiss' team of prosecutors seemed pleased. That evening, Wolf sent the Biden team a list of must-haves for a potential deal, noting that many of them were already in the first draft.

The New York Times story makes clear that Weiss was prepared to take this deal as-is until the IRS whistleblowers came out. It was his decision to require a face-saving "guilty" plea on misdemeanors that eventually blew everything up. Because with a plea a judge would be involved, and as we saw an attentive judge would notice immediately that the deal was corrupt.

Out of that need to save face for Weiss, who had been a good soldier for Biden and the DOJ, a disaster for all has come down. At least so far.

But there' more-- Hunter Biden's lawyers threatened that they would call Joe Biden to the stand if David Weiss didn't grant this get-out-of-jail-free deal.

But why should that bother Weiss? Unless, of course, he was compromised by a conflict of interest.

And what could Joe Biden possibly have to say about Hunter Biden's tax evasion case? For a witness to testify, he must have information relevant to the case. What could Joe Biden say that would be relevant to the question of whether Hunter Biden paid his proper tax liability?

Just to speculate -- perhaps Hunter Biden would say he didn't want to pay taxes on all the money he received from foreign sources, because half of that money was actually Joe Biden's, and he didn't think it was fair that he should pay double the taxes he should pay just because he was doing his dad a favor by holding the bribe money for him.

Does that sound crazy? Well, what on earth else could Joe Biden be called to the stand for?

The fact that Weiss tanked this case just to protect his boss, Joe Biden, is further proof that he has a conflict of interest and must be removed.

Even a CNN legal analyst is willing to say that Weiss has made a "hot mess" of the case.
CNN legal analyst Elie Honig criticized the Department of Justice and Special Cousel David Weiss on Monday and said they made an "unholy mess" of the Hunter Biden investigation.

During an appearance on "CNN This Morning," host Poppy Harlow cited reporting from the New York Times that said Weis was initially willing to forgo any charges against the president's son. The reporting also said that Weis changed his position after a "pair of I.R.S. officials on the case accused the Justice Department of hamstringing the investigation."

"The takeaway is that the DOJ has made an unholy mess of this whole Hunter Biden situation," Honig said. "I fault David Weiss, who I've spoken positively about on this show, given his long service as a U.S. attorney."

"But if you look at that reporting, first he was willing to let this thing go all together. Political pressure ramped up, he backtracks and says, 'oh no we're going to need to take misdemeanor pleas.' Then they go in to court ready to take misdemeanor pleas, more pressure, more testimony from the IRS and then this deal falls apart, and now he says, 'well now I need to be called Special Counsel.'"

Honig said Weiss' actions have been mostly in reaction to IRS whistleblowers.

"It seems like now twice, he's tried to make this case go away cheaply, twice been called out on it, and twice back tracked, only in response to the whistleblowers," Honig said.
