NextImg:California Refuses Department of Education Proposal to Keep State Title IX Eligible

California officials have rejected a proposed resolution agreement from the Education Department’s Office for Civil Rights (OCR) that would resolve issues surrounding biological males in women’s spaces.

Education Secretary Linda McMahon told Governor Gavin Newsom on Monday that he’ll be hearing from U.S. Attorney General Pam Bondi over the state’s refusal to follow federal law.

The California Department of Education (CDE) notified OCR regional director Bradley R. Burke that they had received a June 25 letter from the OCR and responded, “The CDE respectfully disagrees with OCR’s analysis, and it will not sign the Proposed Resolution Agreement.”

Meanwhile, the California Interscholastic Federation (CIF) in a separate response to the OCR’s letter stated that “the CIF concurs with the response of the California Department of Education” in refusing to sign the agreement.

Fox News reports that the U.S. Department of Education’s Office for Civil Rights (OCR) announced late last month that the CIF and the CDE were in violation of Title IX.

The announcement followed a biological male who identifies as a female, dominating high school track and field events by competing in girl’s competitions during the California state championships.

The CDE and CIF  were given 10 days to agree to the OCR’s proposed resolution agreement, which said, “to each female to whom an individual recognition is restored, CDE will send a personalized letter to that girl or woman apologizing on behalf of the state of California for allowing her educational experience to be marred by sex discrimination.”

The Education Department added, “The CDE will issue a Notice to all recipients of federal funding (Recipients) that operate interscholastic athletic programs in California requiring them to comply with Title IX. This will specify that Title IX and its implementing regulations forbids schools from allowing males from participating in female sports and from occupying female intimate facilities, and that Recipients must adopt biology-based definitions of the words ‘male’ and ‘female.’”

California Governor Newsom acknowledges that “it’s a fairness issue,” but has failed to take action to protect women’s spaces from male intrusion.
